1. INTRODUCTION
This Policy forms part of the OnSell Terms and Conditions and applies to the website, app, listings, offers, information requests, reviews, payment-link activity, support and any enabled AI description assistance. It covers Sellers, OnSellers and guest buyers as relevant to their use. Read it alongside the Terms and Privacy Policy.
2. WHO WE ARE
OnSell is operated by ONSELL PTY LTD. Our website is https://onsell.com.au. Our public correspondence address is Suite 1208/530 Little Collins Street, Melbourne VIC 3000, Australia. Contact support@onsell.com.au.
3. USE OF THE SERVICES
Use the Services lawfully and for their intended purpose. Authorised item resale, OnSeller commission earning and external advertising of an authorised listing are permitted. External advertising must follow the relevant marketplace rules and the accepted OnSell transaction agreement.
Do not commit fraud, impersonate another person, create false accounts, conceal a known material fault, fabricate transactions or mislead another participant. Do not evade the agreed OnSell payment or fee process for an accepted OnSell transaction, misuse a pickup code or mark a handover completed when it has not happened.
Do not harvest personal information, scrape or systematically copy the platform's database without permission, bypass access or security controls, interfere with the Services, introduce malicious code or tracking mechanisms, send spam, infringe intellectual property, or copy or reverse engineer software except where the law permits.
Do not harass, threaten, unlawfully discriminate against or misuse another person's information. Good-faith reports, truthful reviews and lawful criticism are allowed. Do not sell or transfer your account or falsely claim OnSell endorsement.
4. AI PRODUCTS
Use description assistance only for its intended purpose. Do not submit unlawful material or use generated text or images to fabricate authenticity, provenance, condition, ownership or a transaction. Do not use the feature to impersonate people, build facial-recognition databases or misuse personal information.
The person publishing a listing must review and correct the output. AI assistance does not replace accurate disclosure of known faults or establish an item's safety, authenticity or market value.
5. COMMUNICATION GUIDELINES
These conduct rules apply to the interaction features actually available, including structured information requests and reviews. They do not promise a forum, open-ended chat or other unavailable feature. Communicate respectfully, use information requests for relevant item questions and do not pressure anyone to share private information or a pickup code prematurely.
6. ARTIFICIAL INTELLIGENCE
Report misleading or harmful output to support with relevant details. We will assess the report and take appropriate action. We do not promise to correct every possible output, publish private complaint information or guarantee that an automated suggestion is unbiased or error-free. Privacy handling is explained in the Privacy Policy.
7. CONTRIBUTIONS AND PROHIBITED GOODS
Upload only material you own or have permission to use. Listings and information-request responses must accurately describe the item and disclose known relevant faults. OnSellers must have the Seller's authority and a reasonable basis for claims they publish. Protect other people's privacy in photographs and text.
Do not submit material that is unlawful, fraudulent, materially misleading, threatening, harassing, unlawfully discriminatory, sexually exploitative, or infringes another person's rights. Do not submit child sexual abuse material, solicit private information from minors or encourage unlawful violence. Genuine reporting of suspected wrongdoing is permitted.
Do not offer stolen, counterfeit, unlawfully obtained or fraudulent goods; illegal drugs or controlled substances; tobacco products; illegal or prohibited hazardous materials; recalled or banned goods; goods that fail applicable mandatory safety standards; or goods that you do not own or have lawful authority to sell. Do not offer a regulated item without any licence, approval or other legal requirement that applies to that sale. The current service does not provide shipping or regulated-delivery handling.
Keep items available and safe pending collection. Sellers acting as businesses must identify that status and comply with their applicable supplier, safety, tax, licensing and recordkeeping obligations. OnSell does not promise exhaustive inspection or pre-screening of every listing. Report unsafe or unlawful items to support promptly.
Do not list stolen or counterfeit goods; unlawful drugs or drug paraphernalia intended for unlawful use; weapons, ammunition or explosives; tobacco, vaping products or alcohol; recalled or unsafe products; identification documents or financial credentials; unlawful sexual material; or goods whose sale breaches applicable wildlife, product safety or other laws. Do not list services or items outside the second-hand item marketplace's supported scope. A legal sale can still be refused where the item is unsupported or presents a reasonably identified safety or payment risk; contact support if uncertain.
8. REVIEW AND RATINGS
Reviews must be based on firsthand experience and honestly describe it. Do not fabricate a review, organise deceptive rating manipulation, conceal material incentives or conflicts, or threaten someone to obtain a favourable rating. Honest complaints and lawful criticism are permitted. A review is not prohibited merely because it alleges a problem or comes from someone associated with a competing business; accuracy, disclosure and lawful conduct are what matter.
9. REPORTING A BREACH OF THIS POLICY
Email support@onsell.com.au with the listing or transaction reference, the concern and relevant evidence. You may report safety, fraud, privacy, copyright, conduct or AI-output issues. Do not knowingly submit false reports. For immediate danger, contact the appropriate emergency service rather than relying on platform support.
We may request further information and assess the issue. Where appropriate we may restrict an affected listing while reviewing safety, fraud or legal risks and address related transactions with the affected participants.
10. CONSEQUENCES OF BREACHING THIS POLICY
Action depends on the nature, seriousness and history of the breach. We may request correction, warn a user, remove content or restrict or suspend access. Immediate action may be necessary for serious safety, fraud or legal concerns. Repeated or serious breaches may result in termination and, where appropriate, referral to a relevant authority.
Where lawful and practicable, we will give a reason and a support review route. Enforcement does not automatically forfeit held funds, cancel valid refund rights or remove OnSell's own obligations. Open transactions, refunds and records must be handled under the Terms and applicable law.
11. COMPLAINTS AND REMOVAL OF LEGITIMATE CONTENT
If you believe content or access was restricted in error, email support with the relevant reference and explanation. We will assess the request within a reasonable time. Content may remain restricted during a genuine safety or legal review. A good-faith complaint is not itself a policy breach.
12. DISCLAIMER
Users are responsible for their own contributions and conduct. We do not guarantee that every item or statement has been independently checked. These qualifications do not exclude rights, remedies or obligations that cannot lawfully be excluded, or all liability for OnSell's own conduct. Guest buyers can use the relevant support and complaint routes even without an account.
